Terms of service

1. General

1.1 These General Terms and Conditions (“GTC”) govern the sale of goods by Dyson GmbH, Lichtstr. 43e, 50825 Cologne (“Dyson”) via the website dyson.de (“Webshop”) to consumers and businesses (“Buyer”, “User”). The use of the Dyson customer account is also governed by these GTC. Dyson does not recognize any conflicting or deviating terms and conditions of the Buyer unless Dyson has expressly agreed to their validity in writing.

1.2 The buyer is a consumer within the meaning of these Terms and Conditions insofar as the purpose of the purchase of goods cannot be attributed to their commercial or self-employed professional activity (Section 13 of the German Civil Code). An entrepreneur within the meaning of these Terms and Conditions is any natural or legal person or partnership with legal capacity who, when concluding the contract, is acting in the exercise of their commercial or self-employed professional activity (Section 14 of the German Civil Code).

2. Contracting parties and conclusion of the contract

2.1 The contractual partner of the buyer (or user) is Dyson.

2.2 Dyson's offers are non-binding. The presentation of products in the Dyson webshop does not constitute a legally binding offer to purchase, but rather a non-binding online catalog. This does not apply if the buyer selects a payment method that results in immediate debiting of the buyer's account (instant bank transfer, PayPal). In this case, the product presentations in the Dyson webshop constitute a binding offer.

2.3 Before submitting the order by clicking the "Buy now" button, the buyer has the opportunity during the ordering process to review all the contents of the order form and to change them by clicking the corresponding button (e.g. "Edit shopping cart" or "Edit address") or to cancel the entire ordering process.

2.4 The buyer's order is generally accepted via a separate email (order confirmation) which outlines the contract details, our terms and conditions, and warranty conditions. If the product presentations in the Dyson online shop constitute a binding offer as described in section 2.2, the buyer accepts the offer by clicking the "Buy now" button. In this case, the contract is concluded upon submission of the order. The buyer will subsequently receive a separate email containing the contract details, our terms and conditions, and warranty conditions.

2.5 Dyson stores the contract text after the contract is concluded. The buyer has no access to this stored text and must rely on the copy of the contract text sent to them with the order confirmation email.

3. Setting up and using a “My Dyson” account

3.1 Dyson offers the possibility to set up a Dyson customer account, regardless of the purchase of a Dyson product, and in this way to take advantage of numerous benefits relating to the goods and services offered by Dyson.

3.2 The “My Dyson” account is free.

3.3 The contract for setting up the Dyson customer account is concluded as follows: after entering the user data, the user clicks the "Submit" button, thereby sending their offer to Dyson for the setup and use of their Dyson customer account. Dyson accepts this offer by sending the user a confirmation email and activating the user's customer account.

3.4 The services that Dyson offers to customer account holders include, in particular,

Exclusive offers on Dyson devices and technologies, reserved only for registered users,

Priority access to new goods, special promotions,

Exclusive invitations to Dyson events and participation in in-home studies using the latest Dyson technology.

 3.5 To provide all the components and benefits of the Dyson customer account, Dyson needs to communicate with the user via the communication channels specified during the account setup, in particular via the user's email address. Specifically, Dyson will send the user emails regarding exclusive Dyson devices and technologies, invitations to exclusive events, and other information concerning the purchase and use of Dyson products, as well as other benefits for users with a Dyson customer account.

3.6 Personal data is processed within the scope of the user relationship. Further information can be found in the  privacy policy .

3.7 Furthermore, the user can cancel their "My Dyson" account at any time by making a corresponding declaration by telephone on 0800 31 31 31 8 (free of charge). The subsequent process for deleting the "My Dyson" account may take up to one month.

4. Prices and Payment Terms

4.1 Dyson's prices are ex-works, including packaging costs and the applicable statutory value-added tax (VAT) at the time of ordering. Prices do not include shipping costs, unless otherwise stated in section 4.2 below. VAT will be shown separately in the order confirmation. If the buyer is a business, Dyson will issue an invoice compliant with the VAT Act free of charge upon written request.

4.2 Standard shipping is free for orders over EUR 49.00. If the order value is less than EUR 49.00, the shipping costs will be displayed separately in the order form. The buyer will be informed about any available paid shipping options (e.g., express shipping, delivery on a specific date, etc.) during the order process.

4.3 The available payment methods are displayed to the buyer at the beginning of the ordering process and can be found via  this link  in the webshop.

4.4 The purchase price is due upon conclusion of the contract for payment methods that result in immediate debiting of the buyer's account; in all other cases, it is due immediately upon shipment of the ordered goods. If payment via the selected payment method fails during the ordering process, the buyer will be informed accordingly. To find out the reasons for the payment failure, the buyer must contact their payment service provider. Further information on payment methods can be  found on the " Shopping at Dyson " page.

4.5 The general terms and conditions of Klarna Bank AB, PayPal, and credit card issuers may need to be taken into account.

5. Shipping and Delivery

5.1 Shipping is only available within the Federal Republic of Germany.

5.2 Delivery will be made as indicated on the product page and during the ordering process.

5.3 If delivery is temporarily delayed due to force majeure or other events that were unforeseeable and unavoidable at the time of conclusion of the contract and for which Dyson is not responsible (e.g. operational disruptions of any kind at Dyson, at third parties commissioned by Dyson or at their contractors, material shortages, epidemics, official orders, etc.), the delivery period shall be extended accordingly for the duration of the force majeure event. 

5.4 If the buyer is an entrepreneur, transport packaging and other packaging will not be taken back in accordance with the Packaging Ordinance; the buyer is obliged to dispose of the packaging at his own expense.

6. Retention of title

6.1 Dyson retains title to the goods until full payment of the purchase price, including any ancillary charges (e.g., exchange fees, financing costs, interest, etc.). If the buyer is a business, Dyson retains title to the goods until all outstanding claims against the buyer have been settled.

6.2 In the event of enforcement measures or other interventions by third parties, the buyer must immediately notify Dyson in writing and provide all documents necessary for Dyson to intervene. If the buyer is a business, they shall bear the costs of Dyson's intervention to the extent that the third party is unable to reimburse these costs and to the extent that the buyer caused the third party's actions.

6.3 The following applies to the resale of goods by businesses: The buyer is only permitted to resell the products subject to retention of title ("reserved goods") in the ordinary course of business. The buyer is not entitled to pledge the reserved goods, transfer them as security, or otherwise dispose of them in a manner that jeopardizes Dyson's ownership. However, the buyer hereby assigns to Dyson all claims against its customers or third parties arising from or in connection with the resale up to the total amount (including VAT) of Dyson's claims against the buyer. Dyson hereby accepts this assignment. The buyer must inform the affected customers and third parties of the assignment without undue delay. Even after the assignment, the buyer remains entitled to collect the assigned claims in trust for Dyson in its own name. Dyson's right to collect these claims itself remains unaffected. Dyson undertakes not to exercise this right as long as the buyer fulfills its payment obligations to Dyson, no payment arrears arise, and in particular, the buyer does not become insolvent and does not suspend payments. However, should any of the aforementioned events occur, the buyer undertakes to inform Dyson of the assigned receivables and the debtors concerned, to provide all details necessary for the collection of the receivables, and to hand over all relevant documents.

6.4 If the buyer is in default of payment for goods, in whole or in part, or if the buyer becomes insolvent, he is not entitled to resell or relinquish possession of goods owned by Dyson until he has fully settled all of Dyson's claims.

7. Resignation

7.1       Dyson is entitled to withdraw from the contract if the buyer has filed an application for the opening of insolvency proceedings over his assets or has submitted an affidavit pursuant to Section 807 of the German Code of Civil Procedure, or if insolvency proceedings have been opened over his assets or the opening has been rejected for lack of assets.

7.2       Dyson is entitled to withdraw from the contract if, despite an existing purchase agreement for the goods or services, Dyson is not supplied through no fault of its own, even though Dyson has concluded a congruent hedging transaction for the goods or services. Dyson will inform the buyer immediately of the failure to supply itself and, in the event of withdrawal, will promptly refund any payment already received.

7.3       Other rights of withdrawal, in particular statutory rights, remain unaffected.

8. Right of withdrawal for consumers

If the buyer is a consumer, he has a right of withdrawal in accordance with the following provisions:

8.1 Cancellation Policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you, or a third party designated by you (other than the carrier), take possession of the goods. For cosmetic products, the right of cancellation expires as soon as the product has been opened.

To exercise your right of withdrawal, you must inform us (Dyson GmbH, Lichtstr. 43e, 50825 Cologne, Germany, Tel. 0800 / 31 31 31 8, Email: support@helpall0rder.com) of your decision to withdraw from this contract by means of an unequivocal statement (e.g. a letter sent by post or email). You may use the model withdrawal form attached in section 8.2, but this is not obligatory.

To meet the cancellation deadline, it is sufficient that you send your notification of exercising your right of cancellation before the cancellation period expires.

Consequences of the revocation

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs incurred if you chose a delivery method other than our cheapest standard delivery option), without undue delay and no later than fourteen days from the day on which we received your notification of withdrawal. For this reimbursement, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement.

We may refuse reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You must return the goods without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract.

to return or hand over the goods. The deadline is met if you send the goods before the end of the fourteen-day period.

We cover the costs for returning machines, spare parts, and accessories. The customer is responsible for the return shipping costs of cosmetic products.

You are only liable for any loss in value of the goods if this loss in value is due to handling of the goods that was not necessary for testing their condition, properties and functionality.

9. Warranty

9.1 In the event of defects in the delivered goods, the buyer is entitled to the statutory warranty rights, subject to the following clauses. However, the buyer may only claim damages for a defect within the scope of clause 12.

9.2 In commercial transactions with businesses, Section 377 of the German Commercial Code (HGB) applies. Dyson is then also entitled, at its discretion – to be exercised within a reasonable period – to repair the goods or deliver new goods. This does not apply if the buyer proves that, in exceptional circumstances, repair is unreasonable for them.

9.3 If the buyer is a business, the limitation period for the buyer's rights due to defects is one year, commencing with the delivery of the goods to the buyer. The limitation provisions of Section 445b of the German Civil Code (BGB) remain unaffected. The statutory limitation periods remain in effect.

(a) for the rights of the buyer in the event of defects fraudulently concealed or intentionally caused;

(b) if and to the extent that Dyson has provided a guarantee;

(c) for claims for damages by the buyer due to a culpable injury to life, body or health;

(d) for claims for damages by the buyer for damages caused intentionally or through gross negligence by Dyson, its legal representatives or agents;

as well as

(f) for claims under the Product Liability Act or other mandatory statutory liability provisions.

10. Guarantees

10.1 If the buyer is a consumer, the statutory warranty period for the goods is two years. The warranties provided by Dyson neither limit nor replace the statutory warranty rights in the event of delivery of a defective item. Rather, the warranties grant the buyer additional rights. Exercising the statutory warranty rights is free of charge.

10.2 The Dyson manufacturer's warranty is governed by the version of the   Dyson warranty terms and conditions valid at the time of conclusion of the contract .

10.3 In addition to and independent of the right of withdrawal and statutory warranty rights, Dyson (Dyson GmbH, Lichtstr. 43e, 50825 Cologne) offers a 30-day return guarantee for customers who are consumers on its entire product range. This applies to all products purchased by the customer from March 1, 2019, onwards at www.dyson.de or in one of our Dyson Demo Stores, provided that:

(a) the customer is a natural person who acquires the goods for purposes which are predominantly neither attributable to his or her commercial nor his or her independent professional activity (consumer),

(b) the goods are complete (including accessories and original packaging) and

(c) the goods show no signs of wear or damage beyond what is normal and proper use of the goods.

This guarantee is not subject to any territorial restrictions.

If you ordered your device(s) between November 1st and December 31st, 2025, you can return your device(s) within 100 days of receipt for a full refund, provided you have activated your warranty. You can   activate your warranty here .

This 100-day return policy does not apply if you purchased your device from a retailer. Further information can be found  here .

To exercise the rights under this guarantee, the customer must return the goods within 30 or 100 days to the following address:

The date of dispatch is decisive for compliance with the 30- or 100-day deadline.

The customer bears the risk of transport. After receipt of the returned item and successful verification that the return guarantee conditions are met, Dyson will refund the purchase price to the customer, provided it has already been paid, using the payment method used by the customer for the purchase price payment.

10.4 Return of cosmetic products and cleaning agents

You can return unopened cosmetic and cleaning products purchased from dyson.de within 14 days of receipt, provided the products are unopened. Once you have opened the product, the statutory right of return is forfeited.

To request a return, please contact our customer service via the channels listed in the "Contact" section. You will then receive return instructions, including the return reference number, which you must include on your return shipment so that it can be linked to your order.

You can arrange shipping with a carrier of your choice. Dyson recommends using a service that allows you to track your shipment so you can obtain proof of delivery. Return shipping costs are the customer's responsibility.

Upon receipt of the return and successful verification of compliance with these return conditions, Dyson will refund the purchase price paid using the original payment method.

11. Repair Information

11.1 Repairs carried out as part of the supplementary performance and the manufacturer's warranty granted under section 10.2 are free of charge for the buyer. After the manufacturer's warranty has expired (and provided that no statutory warranty rights apply), Dyson offers various service packages for chargeable repairs. The costs vary depending on the chosen package and product and can be viewed in detail  here  .

11.2 If a repair is carried out under the warranty, the manufacturer's guarantee, or for a fee, the buyer has the option of having the Dyson appliance collected directly from their home by a courier, or of sending the Dyson appliance to Dyson themselves using a return label provided by Dyson. The appliance will be repaired in a Dyson service center and returned to the buyer. If all spare parts are available, this usually takes three (3) to five (5) working days. 11.3 Accessories and spare parts can also be ordered at  https://www.dyson.de/ersatzteile  or  https://www.dyson.de/support  . Delivery will be made as indicated during the ordering process. In addition to and independently of the statutory warranty rights, Dyson provides a 12-month warranty on accessories and spare parts (in accordance with section 10.2).

12. Liability

12.1     In the case of simple negligence, Dyson shall only be liable for breaches of a material contractual obligation. A material contractual obligation in this sense is an obligation whose fulfillment is essential for achieving the purpose pursued in concluding the contract and on whose fulfillment the buyer may therefore regularly rely.

12.2 In the case of simple negligence, Dyson's liability is limited to foreseeable, typical contractual damages at the time of conclusion of the contract.

12.3 The foregoing exclusions and limitations of liability do not apply to liability in the event of (i) culpable injury to life, body or health, (ii) damage caused intentionally or by gross negligence by Dyson, its legal representatives or agents, (iii) fraudulent concealment of a defect, (iv) the assumption of a guarantee, or (v) claims under the Product Liability Act or other mandatory liability provisions. To the extent that Dyson's liability is excluded or limited, this also applies to the personal liability of Dyson's employees, workers, staff, representatives and agents.

13. Transport damage

If goods are delivered with obvious transport damage, it is very helpful to file an immediate complaint with the delivery person and contact Dyson. This supports Dyson in asserting its own claims against the carrier or transport insurance company. If the buyer is a consumer, however, failure to report the damage to Dyson has no legal consequences for the buyer. If the buyer is a business, the provisions of Section 377 of the German Commercial Code (HGB) remain unaffected.

 

14. Copyrights

Dyson holds the copyright to all images, videos, and texts published online on this platform. Use of these images, videos, and texts is not permitted without Dyson's express consent.

15. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR) at  https://ec.europa.eu/consumers/odr/  . Consumers can use this platform for the out-of-court settlement of disputes concerning contractual obligations arising from online sales contracts. However, Dyson is neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

16. Other

16.1 The contractual relationship between Dyson and the buyer is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). In transactions with consumers, those provisions which are mandatory under the law that would be applicable without this clause (generally the law of the country in which the consumer has their habitual residence) and from which no derogation by agreement is permitted remain unaffected.

16.2 If the buyer is a merchant or a legal entity under public law, Dyson's place of business shall be the exclusive place of jurisdiction for all disputes between Dyson and the buyer. However, Dyson is also entitled to bring legal action against the buyer at the buyer's place of business. The same applies if the buyer does not have a general place of jurisdiction in Germany, or if the buyer has moved their domicile or habitual residence abroad after conclusion of the contract, or if their domicile or habitual residence is unknown at the time the action is brought.

16.3 The place of performance for the obligations arising from the purchase agreement is Duisburg.

16.4 Dyson concludes contracts via the website www.dyson.de exclusively in German.
